Description
Summary:"The number of new cases on bills of lading since the first edition of this book was published four years ago may not have been overwhelmingly large, but a significant number of them have been of first rate importance and have called for considerable rewriting of the text. The House of Lords has been unusually active in the period in question and four of its decisions call for mention here: The Starsin, on provisions defining the identity of the "carrier" where goods are carried in a chartered ship, on Himalaya clauses and on title to sue in tort; The Rafaela S on the question whether straight bills of lading are covered by the Hague-Visby Rules, whether such bills have to be surrendered to the carrier, and whether they are documents of title; Standard Chartered Bank v Pakistan National Shipping Corp on liability for fraudulent statements in bills of lading as to date of shipment; and The Jordan II, on the operational scope of the Hague Rules ... All these (and other) cases have called for considerable rewriting in every chapter of the book. (From the Preface, p. v.)
